Hawthorne treats a five unit rental property as a business, and the municipal code requires a current business tax certificate before you collect rent. Here is the chapter that triggers it, the inspections that gate it, and the renewal date owners miss.

Yes. Hawthorne treats renting five or more residential units as operating a business. Hawthorne Municipal Code Chapter 5.62 requires the owner or operator of a rental of five or more residential units, other than hotels, motels, motor courts or lodging houses, to pay an annual fee, and Chapter 5.02 requires a current business tax certificate.
Most owners assume the question turns on whether they use a management company or hold the property in an LLC. In Hawthorne it does not. Chapter 5.62, Rentals and Rental Businesses, sets the threshold at the property: five or more residential units, and the annual fee applies. Hotels, motels, motor courts and lodging houses are carved out because they are licensed under their own categories, not because they are free.
So a fourplex sits on one side of the line and the building next door sits on the other. Add a unit, convert a garage to a permitted ADU, or buy the property next door and run them as one operation, and you cross the threshold without ever thinking of yourself as having started a business.
The general rules in Chapter 5.02 sit underneath all of it. Every business operating in the city needs a current license, and the categories in 5.62 are how a rental property gets counted as one.
The fee under Chapter 5.62 is annual and scales with the size of the property, and the amounts move with the council's fee schedule. We could not confirm a current per unit figure from a published source as of the date above, so confirm the current fee with the city at 310-349-2935. Ask two things while you have them: the amount for your unit count, and whether an application processing fee and the state mandated disability access fee apply on top of it. Both are standard on Hawthorne business tax applications.
This is the part that turns a two week task into a two month one. The application routes through three departments in sequence.
Planning reviews the application against the zoning for the site and either approves it or denies it, and that approval has to be in hand before the certificate can issue. The number is 310-349-2970. If your building is legal nonconforming, or the unit count on file does not match what is physically there, this is where it surfaces.
On approval from Planning, the application goes to the Department of Building and Safety for an on site inspection and a determination that the building conforms to the city's building regulations. For an older Hawthorne apartment building, expect attention to unpermitted work, converted space, exiting and electrical.
Building approval sends the file to the Fire Department for a fire prevention inspection and a determination of conformance with the fire code. Smoke and carbon monoxide alarms, extinguishers, address visibility, corridor and stairwell clearances, and the condition of any standpipe or alarm system all live here.
Certain business types also require sign off from the Chief of Police, the City Attorney and the City Manager. A straightforward residential rental normally clears with Planning, Building and Fire.
Hawthorne business tax certificates expire on December 31 each year. Renewals are due no later than January 31, and penalties and fines apply after that. Buy a building in October and you are renewing three months later, so treat the first renewal as part of the acquisition.
Licensing must also be notified when the business moves, when the mailing address changes, when ownership or the entity changes, or when it ceases. Moving title into a trust, refinancing into a new LLC, or adding a partner all count.
Do not assume silence means exemption. Chapter 5.02 still governs businesses operating in the city, other chapters set license fees and gross receipts rules, and short term rentals carry their own permit requirements under Chapter 17.74 plus a business license under 5.02.
Under HMC 5.06.020, failing to provide requested information or supplemental documents blocks issuance and is itself a violation. Operating without a certificate is not just a fee liability. It creates a code enforcement record, and that record follows the property into escrow.
The code reaches the owner or operator, and the certificate is normally issued in the ownership entity's name for the property. A manager can prepare and submit the application, but the owner's information, entity documents and signature are what the city needs.
Yes. A change of ownership or change of entity has to be reported to Licensing, and the certificate does not simply transfer with the deed. Handle it at close.
Not to current new construction standards across the board. The inspections check conformance with the city's building and fire code requirements as applied to the existing building, and unpermitted work is the usual finding. Budget for corrections and a reinspection.
Contact Licensing rather than waiting to be found. Cities generally assess the unpaid years plus penalties, and voluntary disclosure is a better posture than complaint driven discovery, which usually arrives with a code enforcement case attached.
Fee schedules, inspection practice and code sections change, and Hawthorne publishes much of this through its Licensing counter rather than online. Confirm the current fee and requirements with the City of Hawthorne, and with a licensed professional, before acting.
